Virginia Background Check Laws and FOIA Rights

Virginia's Freedom of Information Act, found at Virginia Code Title 2.2, Chapter 37, gives the public the right to access government records. This covers records held by the Sheriff's Office, the Circuit Court Clerk, and other county offices. Agencies have five working days to respond to a FOIA request. Accomack County offices follow this timeline.

Criminal history records in Virginia are governed by the statutes at Title 19.2, Chapter 23. This section covers the Central Criminal Records Exchange, who can access records, and what can be released to the public. Full criminal history is available through the VSP CCRE program. Local court records on convictions are generally public unless sealed by a court order.

Virginia passed record sealing legislation that allows some individuals to petition to seal older criminal records. The process is outlined at Virginia Code Section 19.2-392.12. If a record has been sealed, it will not appear in standard court searches. The FOIA Council at foiacouncil.dls.virginia.gov can answer questions about what records are public and how to request them.

Note: Virginia FOIA allows agencies to charge for extensive searches. Simple requests are often free, but large or complex records pulls may carry a fee.
