Scott County Background Check Laws

Virginia law governs how criminal records are collected, stored, and shared. The Central Criminal Records Exchange (CCRE), operated by Virginia State Police, holds statewide criminal history data. Under Virginia Code Title 19.2, Chapter 23, the CCRE collects and maintains records of arrests, convictions, and dispositions from courts and law enforcement agencies across the state.

Scott County law enforcement agencies are required by state law to report arrests and dispositions to the CCRE. This means that criminal records from Scott County cases flow into the statewide database. When someone requests a background check through Virginia State Police, Scott County arrests and convictions will appear if they were properly reported and entered.

Virginia also has laws that let people petition to have certain records expunged. Under Virginia Code Section 19.2-392.12, people who were arrested but not convicted, or whose charges were otherwise dismissed, may be eligible to have those records sealed. This does not remove records automatically. You must file a petition in circuit court. If a court grants the petition, those sealed records are not accessible through standard background check searches.

The Virginia FOIA Council provides guidance on public records access across the state. Their website at foiacouncil.dls.virginia.gov has information on how to make records requests and what rights the public has. Scott County agencies must follow these same rules.

Sex offender registry information for Scott County is available through the Virginia State Police Sex Offender Registry at sex-offender.vsp.virginia.gov. This is a free public database. You can search by name, zip code, or view a map of registered offenders in any area.
